Terms & Booking Conditions
These conditions govern the booking and stay at our holiday apartments. They are designed to be fair and clear, and they do not affect the rights you have as a consumer under Spanish and EU law.

1. Who we are
The accommodations are operated by Dave Lie Sam Foek (“we”, “us”, the “Host”). You can reach us at info@harmonydemijas.com; a postal address and our Spanish tax details are available on request. Each apartment is registered as a tourist establishment in Andalusia and its licence number is shown on the relevant residence page.
2. Scope
These conditions apply to every booking made through this website. If you book through a third-party platform such as Booking.com, that platform’s terms also apply to the booking process and, in case of conflict on the booking itself, the platform’s terms prevail; these conditions then apply to your stay and conduct in the accommodation. Making a booking means you accept these conditions on behalf of everyone in your party.
3. Booking & payment
A booking is confirmed once we (or the platform) issue a written confirmation. Prices are shown per stay and include the taxes indicated at checkout. Payment is taken through our payment provider or the booking platform. You must be at least 18 years old to book.
4. Security deposit
A refundable security deposit is requested: €1,000 for Apartment Harmony in La Cala Golf (payable by credit card only) and €700 for Oasys de Ipanema. It is returned in full after check-out once the accommodation has been inspected, less any amounts properly due under clause 7. The deposit is a security only and does not limit or cap the Guest’s responsibility for damage.
5. Check-in, house rules & occupancy
Check-in and check-out times are shown on the residence page. The number of guests may not exceed the maximum stated for the apartment, and the apartment may not be used for parties, events or commercial filming. Please respect the quiet hours of the community, do not smoke indoors, and follow any community rules provided. Pets are only allowed where the listing states so.
6. Guest registration (identity documents)
Spanish law (Royal Decree 933/2021, the SES.Hospedajes traveller register) requires us to register every guest aged 14 or over and to report their identity document to the authorities within 24 hours of arrival. You must therefore present a valid passport or identity document at check-in, and every adult in the party must be registered. To save time you can complete this online before arrival through our secure check-in form. We keep these records for three years, as the law requires; our Privacy Policy explains how the data is handled and secured.
7. Guest responsibility for damage, theft & cleaning
The Guest must take good care of the accommodation and its contents during the stay. The Guest is responsible and liable for any loss, theft, or damage to the apartment, its furnishings, equipment or inventory caused by the Guest, any member of their party, or their visitors, that goes beyond normal wear and tear.
Where such loss or damage occurs, we may recover from the Guest the reasonable cost of repair, replacement, or additional cleaning, supported by evidence such as photographs, invoices or quotations. Any amount properly due may be deducted from the security deposit; if the cost exceeds the deposit, the Guest remains liable for the difference. For clarity, the Guest is not required to pay for damage they did not cause, for pre-existing defects, or for ordinary wear and tear.
Please report any damage or defect you notice as soon as possible so we can address it promptly.
8. Our responsibility
We are responsible for providing the accommodation as described. To the extent permitted by law, we are not liable for indirect or consequential loss, for the Guest’s own belongings, or for services supplied by independent third parties (such as neighbouring resorts, restaurants or activity providers). Nothing in these conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable consumer law.
9. Cancellations & changes
The cancellation policy that applies to your booking is the one shown at the time of booking. Unless stated otherwise: free cancellation up to 30 days before arrival; 50% of the total is charged for cancellations between 30 and 14 days before arrival; no refund is due for cancellations within 14 days of arrival. Where you booked through a platform, that platform’s cancellation policy applies. If we ever have to cancel for reasons beyond our control, you will be offered a comparable alternative or a full refund of sums paid to us.
10. Right of withdrawal
Under EU and Spanish consumer law, the 14-day right of withdrawal does not apply to accommodation booked for a specific date or period. Your booking is therefore subject to the cancellation policy in clause 9 rather than a withdrawal right.
11. Force majeure
Neither party is liable for failure to perform caused by events beyond its reasonable control, such as natural disasters, extreme weather, utility failures, government measures or similar events.
12. Complaints & dispute resolution
Please contact us first at info@harmonydemijas.com so we can put things right. Official complaint forms (hojas de reclamaciones) are available on request as required in Andalusia. As a consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Governing law
These conditions are governed by Spanish law. As a consumer, you keep the protection of the mandatory rules of your country of residence and may bring proceedings in the courts that consumer law makes available to you.
